9 AN ACT TO MAKE TECHNICAL CORRECTIONS TO TITLE 20 OF
10 THE ARKANSAS CODE CONCERNING PUBLIC HEALTH AND
11 WELFARE; AND FOR OTHER PURPOSES.

19 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

21 SECTION 1. Arkansas Code � 20-22-1011(b), concerning building egress
22 at schools under the Arkansas Comprehensive Fire Protection Act of 1993, is
23 reenacted to ratify the decision by the Arkansas Code Revision Commission to
24 codify the subsection at � 20-22-1011(b).
25 (b) A person shall not be impeded from building egress in compliance
26 with the Arkansas Fire Prevention Code and the standards for accessible
27 design under the Americans with Disabilities Act, 42 U.S.C. � 12101 et seq.,
28 as it existed on January 1, 2023.

30 SECTION 2. Arkansas Code � 20-56-404(d)(2)-(4), concerning permits for
31 the sale, distribution, or manufacture of hemp-derived products, are amended
32 to read as follows to clarify references:
33 (2) When a partnership or limited liability company permitted
34 under this subchapter changes, removes, or replaces the managing partner,
35 managing member, president, or chief executive officer:
36 (A) The existing permit issued under this subchapter is

1 void; and
2 (B) The partnership or limited liability company:
3 (i) Shall apply for a new permit under this
4 subchapter;
5 (ii) May be issued a new permit under this
6 subchapter; and
7 (iii) May operate under the voided permit for no
8 more than thirty (30) days from the date of the change, removal, or
9 replacement of the permit managing partner, managing member, president, or
10 chief executive officer.
11 (3) When a nonpublicly traded corporation permitted under this
12 subchapter changes, removes, or replaces the president or chief executive
13 officer named on the permit or changes, removes, or replaces a stockholder
14 who owns fifty percent (50%) or more of the total voting shares of the
15 nonpublicly traded corporation's stock:
16 (A) The permit issued under this subchapter is void; and
17 (B) The nonpublicly traded corporation:
18 (i) Shall apply for a new permit under this
19 subchapter;
20 (ii) May be issued a new permit under this
21 subchapter; and
22 (iii) May operate under the voided permit for no
23 more than thirty (30) days from the date of the change, removal, or
24 replacement of the permit president, chief executive officer, or stockholder.
25 (4) When a publicly traded corporation permitted under this
26 subchapter changes, removes, or replaces the president or chief executive
27 officer named on the permit or changes, removes, or replaces a stockholder
28 who owns fifty percent (50%) or more of the total voting shares of the
29 publicly traded corporation's stock:
30 (A) The permit issued under this subchapter is void; and
31 (B) The publicly traded corporation:
32 (i) Shall apply for a new permit under this
33 subchapter;
34 (ii) May be issued a new permit under this
35 subchapter; and
36 (iii) May operate under the voided permit for no

1 more than thirty (30) days from the date of the change, removal, or
2 replacement of the permit president, chief executive officer, or stockholder.

4 SECTION 3. DO NOT CODIFY. CONSTRUCTION AND LEGISLATIVE INTENT.
5 It is the intent of the General Assembly that:
6 (1) The enactment and adoption of this act shall not expressly
7 or impliedly repeal an act passed during the regular session of the Ninety-
8 Fifth General Assembly;
9 (2) To the extent that a conflict exists between an act of the
10 regular session of the Ninety-Fifth General Assembly and this act:
11 (A) The act of the regular session of the Ninety-Fifth
12 General Assembly shall be treated as a subsequent act passed by the General
13 Assembly for the purposes of:
14 (i) Giving the act of the regular session of the
15 Ninety-Fifth General Assembly its full force and effect; and
16 (ii) Amending or repealing the appropriate parts of
17 the Arkansas Code of 1987; and
18 (B) Section 1-2-107 shall not apply; and
19 (3) This act shall make only technical, not substantive, changes
20 to the Arkansas Code of 1987.
