12 CANCER; AND FOR OTHER PURPOSES.

18 CLARIFY THE COST-SHARING REQUIREMENTS
19 FOR EXAMINATIONS FOR BREAST CANCER.

21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

23 SECTION 1. Arkansas Code � 23-79-140(c), concerning mammographies
24 performed in an unaccredited facility, is amended to read as follows:
25 (c)(1) A healthcare insurer shall not pay for mammographies performed
26 in an unaccredited facility after January 1, 1990.
27 (2) This section applies to a credentialed or accredited place
28 of service in which the service is provided.

30 SECTION 2. Arkansas Code � 23-79-140(e), concerning copayments and
31 deductibles under a health benefit plan for examinations for breast cancer,
32 is amended to read as follows:
33 (e)(1) Benefits under this section are subject to any health benefit
34 plan provisions that apply to other services covered by the health benefit
35 plan, except that a health benefit plan shall not impose a copayment or
36 deductible cost-sharing requirement for a screening mammogram, even if:

1 (A) A service is provided on different dates of service;
2 or
3 (B) More than one (1) service is provided on the same date
4 of service.
5 (2) A breast ultrasound shall not be subject to a deductible or
6 any applicable copayment cost-sharing requirement, even if:
7 (A) A service is provided on different dates of service;
8 or
9 (B) More than one (1) service is provided on the same date
10 of service.
11 (3) A healthcare insurer shall ensure that an individual's cost-
12 sharing requirement under a health benefit plan that is applicable to a
13 diagnostic examination for breast cancer, including breast magnetic resonance
14 imaging, is no less favorable than the cost-sharing requirement that is
15 applicable to a screening examination for breast cancer.
