10  OTHER PLACE OF WORSHIP; TO PROVIDE CIVIL IMMUNITY FOR

11  VOLUNTEER SECURITY PERSONNEL IN A CHURCH OR OTHER

12  PLACE OF WORSHIP; AND FOR OTHER PURPOSES.

17                       OR OTHER PLACE OF WORSHIP; AND TO

18                       PROVIDE CIVIL IMMUNITY FOR VOLUNTEER

19                       SECURITY PERSONNEL IN A CHURCH OR OTHER

20                       PLACE OF WORSHIP.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24  SECTION 1. Arkansas Code � 16-120-501, concerning definitions related

25 to charitable immunity for a church or other place of worship, is amended to

26 add an additional subdivision to read as follows:

27  (3) "Volunteer security person" means a person who provides

28 safety, security, or protection for a church or other place of worship as

29 authorized by the church or other place of worship to benefit persons in

30 attendance at a meeting or other gathering held at or sponsored by the church

31 or other place of worship without any express or implied promise of

32 remuneration.

34  SECTION 2. Arkansas Code Title 16, Chapter 120, Subchapter 5, is

35 amended to add an additional section to read as follows:

36  16-120-506. Civil immunity for volunteer security personnel.

1   (a) Except as provided in subsections (b) and (d) of this section, the

2 following are not subject to civil liability for damages, injury, or death

3 resulting from or arising out of a negligent act or omission by a volunteer

4 security person who is providing safety, security, or protection services for

5 a church or other place of worship:

6   (1) The volunteer security person providing the safety,

7 security, or protection services; and

8   (2) The church or other place of worship for which the volunteer

9 security person is providing safety, security, or protection services.

10  (b) A church or other place of worship or a volunteer security person

11 is entitled to civil immunity under this section if the:

12  (1) Church or other place of worship requires adequate training

13 in the provision of safety, security, or protection services for a person to

14 become a volunteer security person; and

15  (2) Volunteer security person has received the training required

16 by the church or other place of worship.

17  (c) The civil immunity provided by this section includes without

18 limitation civil immunity for the use of nonlethal or lethal force in

19 providing safety, security, or protection services.

20  (d) The civil immunity provided by this section does not apply to or

21 include an act or omission that arises out of intentional, reckless, or

22 grossly negligent conduct.
