9              AN ACT TO AMEND THE ARKANSAS EGG MARKETING ACT OF

10             1969; TO AUTHORIZE REPACKAGING OF EGGS BY A RETAILER

11             IF CERTAIN CRITERIA IS MET; AND FOR OTHER PURPOSES.

16                       OF 1969; AND TO AUTHORIZE REPACKAGING OF

17                       EGGS BY A RETAILER IF CERTAIN CRITERIA

18                       IS MET.

20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22  SECTION 1. Arkansas Code � 20-58-207(e), concerning prohibited acts

23 under the Arkansas Egg Marketing Act of 1969, is amended to read as follows:

24  (e)(1) Except as provided in subdivision (e)(2) of this section, eggs

25 Eggs in retail shall not be removed from the immediate container in which the

26 eggs were received and placed into a different container by the retailer.

27             (2) Eggs in retail may be removed from the immediate container

28 in which the eggs were received and placed into a different container by the

29 retailer if eggs used to replace missing or broken eggs:

30                       (A) Are of the same packer as the missing or broken eggs,

31 as evidenced by the license number printed or stamped on the carton or

32 container;

33                       (B) Are of the same grade and size as the missing or

34 broken eggs, as evidenced by the label on the carton or container;

35                       (C) Have the same expiration date, lot code, or Julian

36 date as the missing or broken eggs, as evidenced by the label or stamp on the

1 carton or container;

2   (D) Are from the same brand as the missing or broken eggs,

3 as evidenced by the label; and

4   (E) Are visibly clean with no prominent stains, adhering

5 dirt, debris, fecal matter, or other foreign material.
