9   AN ACT CONCERNING SPOUSAL RETIREMENT BENEFITS OF CITY

10  ATTORNEYS OF CITIES OF THE FIRST CLASS AND CITIES OF

11  THE SECOND CLASS, DEPUTY CITY CLERKS IN CITIES OF THE

12  FIRST CLASS, MAYORS IN CITIES OF THE SECOND CLASS,

13  AND TREASURERS IN CITIES OF THE FIRST CLASS; AND FOR

14  OTHER PURPOSES.

18                       CONCERNING SPOUSAL RETIREMENT BENEFITS

19                       FOR SPOUSES OF CERTAIN MUNICIPAL

20                       EMPLOYEES.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

23

24  SECTION 1. Arkansas Code � 24-12-120, concerning retirement benefits

25 for city attorneys in cities of the first class and cities of the second

26 class, is amended to add an additional subsection to read as follows:

27  (d)(1) Upon the death of a city attorney who retired under the

28 provisions of subsection (a) of this section or a city attorney who dies in

29 office after becoming eligible to retire under subsection (a) of this section

30 or any other state statute, the legally recognized spouse of the city

31 attorney married to the city attorney for ten (10) years or longer may

32 receive, at the option of the governing body of the city:

33                       (A) One-half (1/2) of the retirement benefit the retired

34 city attorney was receiving; or

35                       (B) One-half (1/2) of the retirement benefit the city

36 attorney who died in office was entitled to receive.

1             (2) Upon remarriage of the spouse, the benefits shall cease.

3   SECTION 2. Arkansas Code � 24-12-122, concerning retirement benefits

4 for deputy city clerks in cities of the first class, is amended to add an

5 additional subsection to read as follows:

6   (c)(1) Upon the death of a deputy city clerk who retired under the

7 provisions of subsection (a) of this section or a deputy city clerk who dies

8 in office after becoming eligible to retire under subsection (a) of this

9 section or any other state statute, the legally recognized spouse of the

10 deputy city clerk married to the deputy city clerk for ten (10) years or

11 longer may receive, at the option of the governing body of the city:

12            (A) One-half (1/2) of the retirement benefit the retired

13 deputy city clerk was receiving; or

14            (B) One-half (1/2) of the retirement benefit the deputy

15 city clerk who died in office was entitled to receive.

16            (2) Upon remarriage of the spouse, the benefits shall cease.

18  SECTION 3. Arkansas Code � 24-12-124, concerning retirement benefits

19 for mayors in cities of the second class, is amended to add an additional

20 subsection to read as follows:

21  (d)(1) Upon the death of a mayor who retired under the provisions of

22 subsection (a) of this section or a mayor who dies in office after becoming

23 eligible to retire under subsection (a) of this section or any other state

24 statute, the legally recognized spouse of the mayor married to the mayor for

25 ten (10) years or longer may receive, at the option of the governing body of

26 the city:

27            (A) One-half (1/2) of the retirement benefit the retired

28 mayor was receiving; or

29            (B) One-half (1/2) of the retirement benefit the mayor who

30 died in office was entitled to receive.

31            (2) Upon remarriage of the spouse, the benefits shall cease.

33  SECTION 4. Arkansas Code � 24-12-125, concerning retirement benefits

34 for treasurers in cities of the first class, is amended to add an additional

35 subsection to read as follows:

36  (c)(1) Upon the death of a treasurer who retired under the provisions

1 of subsection (a) of this section or a treasurer who dies in office after

2 becoming eligible to retire under subsection (a) of this section or any other

3 state statute, the legally recognized spouse of the treasurer married to the

4 treasurer for ten (10) years or longer may receive, at the option of the

5 governing body of the city:

6   (A) One-half (1/2) of the retirement benefit the retired

7 treasurer was receiving; or

8   (B) One-half (1/2) of the retirement benefit the treasurer

9 who died in office was entitled to receive.

10  (2) Upon remarriage of the spouse, the benefits shall cease.
