15 TO CREATE THE MOMNIBUS ACT; AND TO AMEND
16 ARKANSAS LAW TO IMPROVE MATERNAL HEALTH
17 IN THIS STATE.

19 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

21 SECTION 1. DO NOT CODIFY. Title.
22 This act shall be known and may be cited as the "Momnibus Act".
23
24 SECTION 2. Arkansas Code � 20-77-151 is repealed to be reenacted and
25 transferred to another subchapter of the Arkansas Code.
26 20-77-151. Depression screening for pregnant women.
27 (a) The Arkansas Medicaid Program shall reimburse for depression
28 screening of a pregnant woman.
29 (b) The Department of Human Services shall apply for any federal
30 waiver, Medicaid state plan amendments, or other authority necessary to
31 implement this section.

33 SECTION 3. Arkansas Code Title 20, Chapter 77, is amended to add an
34 additional subchapter to read as follows:
35 Subchapter 29 -- Maternal Health

1 20-77-2901. Depression screening for pregnant women.
2 (a) The Arkansas Medicaid Program shall reimburse for depression
3 screening of a pregnant woman.
4 (b) The Department of Human Services shall apply for any federal
5 waiver, Medicaid state plan amendments, or other authority necessary to
6 implement this section.

8 20-77-2902. Coverage of prenatal, delivery, and postpartum services.
9 (a) The Arkansas Medicaid Program shall reimburse for prenatal,
10 delivery, and postpartum services separately in lieu of a global payment or
11 an all-inclusive payment methodology for maternity services.
12 (b) Prenatal, delivery, and postpartum services include without
13 limitation:
14 (1) Laboratory fees;
15 (2) Physician ordered testing;
16 (3) Blood work;
17 (4) Remote monitoring;
18 (5) Fetal nonstress tests; and
19 (6) Continuous glucose monitors or other services for
20 gestational diabetes.
21 (c) This section does not alter coverage provided through the Arkansas
22 Health and Opportunity for Me Program or a risk-based provider organization
23 under the Medicaid Provider-Led Organized Care Act, � 20-77-2701 et seq.

25 20-77-2903. Extension of one year for postpartum coverage.
26 The Department of Human Services shall:
27 (1)(A) Extend postpartum Medicaid coverage for mothers to one
28 (1) year in duration.
29 (B) If a mother is eligible to be enrolled under the
30 Arkansas Health and Opportunity for Me Act of 2021, � 23-61-1001 et seq., the
31 extended postpartum Medicaid coverage shall be delivered as provided under
32 the Arkansas Health and Opportunity for Me Act of 2021, � 23-61-1001 et seq.
33 (C) If a mother is not eligible to be enrolled under the
34 Arkansas Health and Opportunity for Me Act of 2021, � 23-61-1001 et seq., the
35 extended postpartum Medicaid coverage shall be delivered through the
36 traditional Arkansas Medicaid Program; and

1 (2) Take necessary action, including without limitation
2 submitting and applying for a state plan amendment or waiver, to obtain
3 federal approval to adopt one-year postpartum Medicaid coverage for a mother
4 who has recently given birth.

6 20-77-2904. Presumptive eligibility for pregnant women.
7 (a) The Arkansas Medicaid Program shall make presumptive eligibility
8 determinations for pregnant women who are applying for the program to improve
9 access to prenatal care and allow prenatal care to be delivered immediately
10 while waiting for a full application to be processed.
11 (b) The program may designate one (1) or more qualified entities to
12 screen for eligibility and immediately enroll pregnant women into the
13 program.

15 20-77-2905. Blood pressure monitoring for pregnant and postpartum
16 women.
17 (a) The Arkansas Medicaid Program shall provide coverage and
18 reimbursement for self-measurement blood pressure monitoring services for
19 pregnant women and postpartum women.
20 (b) Self-measurement blood pressure monitoring services shall include:
21 (1) Validated blood pressure monitoring devices, such as a blood
22 pressure cuff and replacement cuffs, as necessary, to diagnose or treat
23 hypertension;
24 (2) Patient education and training on the set-up and use of a
25 self-measurement blood pressure measurement device that is validated for
26 clinical accuracy, device calibration, and the procedure for obtaining self-
27 measurement readings; and
28 (3) Collection of data reports by the patient or caregiver for
29 submission to a healthcare provider to communicate blood pressure readings
30 and create or modify treatment plans.

32 20-77-2906. Reimbursement for remote ultrasound procedures.
33 (a)(1) The Arkansas Medicaid Program shall reimburse for remote
34 ultrasound procedures utilizing established Current Procedural Terminology
35 codes for remote ultrasound procedures when the patient is in a residence or
36 other off-site location from the healthcare provider of the patient and the

1 same standard of care is met.
2 (2) Subdivision (a)(1) of this section shall apply to the fee-
3 for-service categories of the program and any managed care plan within the
4 program.
5 (b) A remote ultrasound procedure shall be reimbursable when the
6 healthcare provider uses digital technology that:
7 (1) Collects medical and other forms of health data from a
8 patient and electronically transmits the information securely to a healthcare
9 provider in a different location for interpretation and recommendation;
10 (2) Is compliant with the Health Insurance Portability and
11 Accountability Act of 1996, 42 U.S.C. � 1320d et seq., as it existed on
12 January 1, 2025; and
13 (3) Is approved by the United States Food and Drug
14 Administration.

16 20-77-2907. Coverage for certain services provided by doulas and
17 community health workers.
18 The Arkansas Medicaid Program shall reimburse doulas and community
19 health workers for:
20 (1) Home visitation related to postpartum care; and
21 (2) Lactation and breastfeeding services.

23 20-77-2908. Implementation and rules.
24 The Department of Human Services shall:
25 (1) Apply for any federal waiver, Medicaid state plan
26 amendments, or other authority necessary to implement this subchapter; and
27 (2) Adopt rules to implement this subchapter.

29 SECTION 4. Arkansas Code Title 27, Chapter 15, Subchapter 3, is
30 amended to add an additional section to read as follows:
31 27-15-318. Temporary special certificate during and after pregnancy.
32 (a) This section shall be known and may be cited as the "Hayley
33 Sission Act".
34 (b) A woman who is pregnant, as determined by a licensed physician,
35 may apply to the Office of Motor Vehicle for a temporary person-with-a-
36 disability special certificate.

1 (c) The temporary special certificate under subsection (b) of this
2 section shall:
3 (1) Conform to the requirements under � 27-15-304; and
4 (2) Expire one (1) year following the date the pregnant woman
5 gives birth.
