9            AN ACT TO ALLOW A PUBLIC TRANSIT AUTHORITY TO BECOME

10           A PARTICIPATING PUBLIC EMPLOYER AND FOR ITS EMPLOYEES

11           TO BECOME MEMBERS OF THE ARKANSAS PUBLIC EMPLOYEES'

12           RETIREMENT SYSTEM; AND FOR OTHER PURPOSES.

19                       OF THE ARKANSAS PUBLIC EMPLOYEES'

20                       RETIREMENT SYSTEM.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24  SECTION 1. Arkansas Code � 24-4-101(28), concerning the definition of

25 "nonstate employees" applicable to the Arkansas Public Employees' Retirement

26 System, is amended to read as follows:

27           (28) "Nonstate employees" means county employees, municipal

28 employees, rural waterworks facilities board employees, regional airport

29 authority employees, border municipal airport employees, public facilities

30 board employees, regional solid waste management board employees, joint

31 county and municipal sanitation authority employees, employees of a public

32 transit authority, regional water distribution board employees, the employees

33 of economic development districts recognized as planning and development

34 districts under � 14-166-202, school employees, public water authority

35 employees, and the employees of the Intergovernmental Juvenile Detention

36 Council;

2   SECTION 2. Arkansas Code � 24-4-101(30)(A), concerning the definition

3 of "participating public employer" applicable to the Arkansas Public

4 Employees' Retirement System, is amended to read as follows:

5   (A) Any county, municipality, rural waterworks facilities

6 board, regional airport authority, border municipal airport authority, public

7 facilities board, regional solid waste management board, joint county and

8 municipal sanitation authority, a public transit authority, suburban

9 improvement district under � 14-92-502, public water authority, or regional

10 water distribution board in the state whose employees are included in the

11 membership of the Arkansas Public Employees' Retirement System;

13  SECTION 3. Arkansas Code � 24-4-101, concerning definitions applicable

14 to the Arkansas Public Employees' Retirement System, is amended to add an

15 additional subdivision to read as follows:

16  (48) "Public transit authority" means a public governmental

17 entity formed under the Public Transit System Act, � 14-334-101 et seq., that

18 has elected to participate as a public employer in the Arkansas Public

19 Employees' Retirement System by a majority vote of the public transit

20 authority's board of directors.
