14 of the Military for the 2025-2026 fiscal year, the following maximum number
15 of part-time or temporary employees, to be known as "Extra Help", payable
16 from funds appropriated herein for such purposes: one hundred twenty-seven
17 (127) temporary or part-time employees, when needed, at rates of pay not to
18 exceed those provided in the Uniform Classification and Compensation Act, or
19 its successor, or this act for the appropriate classification.

32 GENERALS SALARY. The line item maximums for the State of Arkansas Adjutant
33 General and Deputy Adjutant General are based on the salary grid by the
34 United States Department of Defense. Incumbents in these positions shall be
35 compensated in accordance with the Department of Defense Advisory Service Pay
36 Plan and are not guaranteed placement at the maximum level. The line item

1 maximum salaries may be adjusted on July 1 of each fiscal year to incorporate
2 salary rate changes that have been implemented by the U.S. Department of
3 Defense.
4 The provisions of this section shall be in effect only from July 1, 2024
5 2025 through June 30, 2025 2026.

7 SECTION 14. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS
8 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.
9 PROMOTIONAL ITEMS. The State Military Department is hereby authorized to
10 transfer appropriation from Operating Expenses to Promotional Items in the
11 General Operations Appropriation and/or Cash Operations Appropriation
12 provided by this Act in an amount not to exceed ten thousand dollars
13 ($10,000) each fiscal year, as authorized by the Director of State Resources,
14 and with the approval of the Chief Fiscal Officer of the State.
15 The provisions of this section shall be in effect only from July 1, 2024
16 2025 through June 30, 2025 2026.

18 SECTION 15. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS
19 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.
20 CARRY FORWARD OF FUNDS.
21 (a) The Chief Fiscal Officer of the State shall cause to be transferred
22 on his or her books and those of the State Treasurer and Auditor of State the
23 balance of funds remaining in the Department of Military Fund Account on June
24 30, 2025 2026 into a sub-fund created within the Department of Military Fund
25 to be used exclusively for construction, maintenance and operating expenses
26 or for future construction projects of the State Military Department.
27 (b) Any carry forward of unexpended balance of funding as authorized
28 herein, may be carried forward under the following conditions:
29 (1) The Office of Budget of the Department of Finance and
30 Administration shall report to the Legislative Council all amounts carried
31 forward by the September meeting of the Legislative Council or the Joint
32 Budget Committee meeting which report shall include the name of the agency,
33 board, commission, or institution and the amount of funding carried forward,
34 the program name or line item and the funding source; and
35 (2) The State Military Department shall provide a written report
36 to the Legislative Council or Joint Budget Committee containing all

1 information set forth in subdivision (b)(1) of this section no later than
2 thirty (30) days prior to the time the Department presents its budget request
3 to the Legislative Council or Joint Budget Committee, or both; and
4 (3) Thereupon, the Department of Finance and Administration shall
5 include all information obtained in subdivision (b)(2) of this section in the
6 budget manuals.
7 The provisions of this section shall be in effect only from July
8 1, 2024 2025 through June 30, 2025 2026.

10 SECTION 16. COMPLIANCE WITH OTHER LAWS. Disbursement of funds
11 authorized by this act shall be limited to the appropriation for such agency
12 and funds made available by law for the support of such appropriations; and
13 the restrictions of the State Procurement Law, the General Accounting and
14 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary
15 Procedures and Restrictions Act, or their successors, and other fiscal
16 control laws of this State, where applicable, and regulations promulgated by
17 the Department of Finance and Administration, as authorized by law, shall be
18 strictly complied with in disbursement of said funds.

20 SECTION 17. LEGISLATIVE INTENT. It is the intent of the General
21 Assembly that any funds disbursed under the authority of the appropriations
22 contained in this act shall be in compliance with the stated reasons for
23 which this act was adopted, as evidenced by the Agency Requests, Executive
24 Recommendations and Legislative Recommendations contained in the budget
25 manuals prepared by the Department of Finance and Administration, letters, or
26 summarized oral testimony in the official minutes of the Arkansas Legislative
27 Council or Joint Budget Committee which relate to its passage and adoption.

29 SECTION 18. EMERGENCY CLAUSE. It is found and determined by the
30 General Assembly, that the Constitution of the State of Arkansas prohibits
31 the appropriation of funds for more than a one (1) year period; that the
32 effectiveness of this Act on July 1, 2025 is essential to the operation of
33 the agency for which the appropriations in this Act are provided, and that in
34 the event of an extension of the legislative session, the delay in the
35 effective date of this Act beyond July 1, 2025 could work irreparable harm
36 upon the proper administration and provision of essential governmental

1 programs. Therefore, an emergency is hereby declared to exist and this Act
2 being necessary for the immediate preservation of the public peace, health
3 and safety shall be in full force and effect from and after July 1, 2025.
