9            AN ACT TO AMEND THE LAW CONCERNING THE FORM OF

10           BALLOTS; TO AMEND THE LAW CONCERNING THE USE OF A

11           PREFIX IN AN ELECTION FOR A NONPARTISAN JUDICIAL

12           OFFICE BY AN APPOINTEE TO A NONPARTISAN JUDICIAL

13           OFFICE; TO ALLOW A CANDIDATE FOR THE OFFICE OF

14           JUSTICE OF THE SUPREME COURT OR JUDGE OF THE COURT OF

15           APPEALS WHO IS SERVING IN THAT POSITION AS AN

16           APPOINTEE TO USE THE TITLE OF THAT POSITION AS A

17           PREFIX ON THE BALLOT; AND FOR OTHER PURPOSES.

21                       TO ALLOW A CANDIDATE FOR THE OFFICE OF

22                       JUSTICE OF THE SUPREME COURT OR JUDGE OF

23                       THE COURT OF APPEALS WHO IS SERVING IN

24                       THAT POSITION AS AN APPOINTEE TO USE THE

25                       TITLE OF THAT POSITION AS A PREFIX ON

26                       THE BALLOT.

28 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

30  SECTION 1. Arkansas Code � 7-7-305(c)(1)(B), concerning the form of

31 ballots and the use of a prefix to the name of a person who files for an

32 elective office, is amended to read as follows:

33                        (B) A person may use as the prefix the title of a

34 nonpartisan judicial office in an election for a nonpartisan judicial office

35 only if:

36                        (i) The person is currently serving in a nonpartisan

1 judicial office to which the person has been elected in the last election for

2 the office; or

3                  (ii) The person:

4                             (a) Is a candidate for the office of Justice

5 of the Supreme Court, Judge of the Court of Appeals, circuit judge, or

6 district judge;

7                             (b) Is currently serving in the office of

8 Justice of the Supreme Court, Judge of the Court of Appeals, circuit judge,

9 or district judge as an appointee; and

10                            (c) Has been serving in that position for at

11 least twelve (12) months.
