19 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

21 SECTION 1. Arkansas Code � 20-10-702 is amended to read as follows:
22 20-10-702. Definitions.
23 As used in this subchapter:
24 (1) "General nursing experience" means nursing experience
25 obtained through employment, internship, externship, or other means and
26 includes without limitation employment in a nursing assistant education
27 program or employment in or supervision of nursing students in a nursing
28 facility or unit, a geriatrics department excluding a geriatric psychiatry
29 department, a long-term acute care hospital, home healthcare, hospice care,
30 or other long-term care setting;
31 (2) "Long-term care facility" means a nursing home, a
32 residential care facility, an assisted living facility, an adult daycare
33 facility, or any other facility which provides long-term medical or personal
34 care; and
35 (2)(3) "Primary instructor" means a registered nurse who:
36 (A)(i) Is licensed in this state; or

1 (ii) Holds a multistate privilege to practice if the
2 registered nurse moves from a state that has joined the Interstate Nurse
3 Licensure Compact, �17-87-601 et seq., to Arkansas and meets all requirements
4 for licensure in Arkansas;
5 (B) Does not have any disciplinary action regarding his or
6 her license by the licensing entity or authority; and
7 (C)(i) Possesses a minimum of two (2) years' general
8 nursing experience as a registered nurse including at least one (1) year of
9 long-term care nursing services in a nursing facility setting within the last
10 five (5) ten (10) years; and
11 (D) Annually attends an eight (8) hour class authorized by
12 the Department of Human Services regarding updates to applicable laws and
13 rules, best practices, and common issues encountered in long-term care
14 facilities.
15 (ii) As used in this section, "general nursing
16 experience" may include without limitation employment in a nursing assistant
17 education program or employment in or supervision of nursing students in a
18 nursing facility or unit, geriatrics department excluding a geriatric
19 psychiatry department, long-term acute care hospital, home healthcare,
20 hospice care, or other long-term care setting.
