9            AN ACT TO AMEND THE LAWS CONCERNING TRANSFER OF FUNDS

10           FOR THE COSTS OF ADMINISTERING THE ARKANSAS JUDICIAL

11           RETIREMENT SYSTEM AND THE STATE POLICE RETIREMENT

12           SYSTEM; AND FOR OTHER PURPOSES.

16                       TO AMEND THE LAWS CONCERNING TRANSFER OF

17                       FUNDS FOR THE COSTS OF ADMINISTERING THE

18                       ARKANSAS JUDICIAL RETIREMENT SYSTEM AND

19                       THE STATE POLICE RETIREMENT SYSTEM.

20

21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22

23  SECTION 1. Arkansas Code � 19-5-914(c), concerning disbursement or

24 transfer of moneys in the Judges Retirement Fund, is amended to read as

25 follows:

26  (c)(1) The Judges Retirement Fund shall be disbursed or transferred as

27 provided by law for:

28                       (A) The benefit of retirants and for investment;

29                       (B) Investment purposes; and

30                       (C) The costs of administering the Arkansas Judicial

31 Retirement System.

32           (2) Moneys shall be transferred from the Judges Retirement Fund

33 to the Arkansas Public Employees' Retirement System for administration and

34 management of the Arkansas Judicial Retirement System as authorized by law.

36  SECTION 2. Arkansas Code � 19-5-917(c), concerning disbursement or

1 transfer of moneys in the State Police Retirement Fund, is amended to read as

2 follows:

3   (c)(1) The State Police Retirement Fund shall be used for payment of

4 personal services, operating expenses, investments, benefits, refunds, and

5 for such other purposes as may be authorized by law and in � 24-6-201 et seq.

6           (2) Moneys shall be transferred from the State Police Retirement

7 Fund to the Arkansas Public Employees' Retirement System for administration

8 and management of the State Police Retirement System as authorized by law.

10  SECTION 3. Arkansas Code � 24-8-204(c), concerning authorization by

11 the Board of Trustees of the Arkansas Judicial Retirement System for the

12 payment of expenses related to administering the Arkansas Judicial Retirement

13 System, is amended to read as follows:

14  (c) All costs of administering the Arkansas Judicial Retirement System

15 shall be paid from the Judges Retirement Fund, but no payment for such

16 expenses shall be made unless authorized by the board.

18  SECTION 4. Arkansas Code Title 24, Chapter 4, Subchapter 2, is amended

19 to add an additional section to read as follows:

20  24-4-214. Transfers for administrative functions of Arkansas Public

21 Employees' Retirement System.

22  (a)(1) Beginning July 1, 2027, and thereafter, a sum shall be

23 transferred each fiscal year from the Judges Retirement Fund to the Arkansas

24 Public Employees' Retirement System as necessary for costs incurred by the

25 Arkansas Public Employees' Retirement System in administering the Arkansas

26 Judicial Retirement System.

27          (2) The sum to be transferred shall be the percentage of the

28 Arkansas Public Employees' Retirement System's total cost of administration

29 calculated using a 50/50 weighted average of the Arkansas Judicial Retirement

30 System's pro-rata percentage of total invested assets and pro-rata percentage

31 of total membership.

32          (3) The transfer request shall be made to the Chief Fiscal

33 Officer of the State, and upon his or her approval, the transfer shall be

34 made on the books of the:

35          (A) Chief Fiscal Officer of the State;

36          (B) The Treasurer of State; and

1   (C) The Auditor of State.

18  (c) As used in this section:

19  (1) "Total invested assets" means the combined value of the

20 investment assets of the Arkansas Public Employees' Retirement System, the

21 Arkansas Judicial Retirement System, and the State Police Retirement System

22 at the end of each fiscal year; and

23  (2) "Total membership" means the combined number of active,

24 inactive, and retired members covered by the Arkansas Public Employees'

25 Retirement System, the Arkansas Judicial Retirement System, and the State

26 Police Retirement System at the end of each fiscal year.
