20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22 SECTION 1. REGULAR SALARIES. There is hereby established for the
23 Arkansas Department of Transportation for the 2025-2026 fiscal year, the
24 following maximum number of regular employees and the maximum annual salary
25 for such employees; and no greater salary than that established herein shall
26 be paid to any employee from appropriations hereinafter made for said
27 department. The annual salaries to be paid to each employee authorized herein
28 shall be determined by the Arkansas State Highway Commission within the
29 limitations as set out in this Section and the funds and the appropriations
30 made available for such purposes. All positions established herein shall be
31 exempt from the provisions of the Uniform Classification and Compensation Act
32 (Arkansas Code � 21-5-201, et seq.), or its successor, but shall not be
33 exempt from the provisions of the Regular Salaries Procedures and
34 Restrictions Act. Provided further that the salaries for the pay period
35 beginning June 2025 and ending July 2025 can be paid from the salaries and
36 overtime authorized for the fiscal year ending June 30, 2026.

6 2025 through June 30, 2025 2026.

8 SECTION 15. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS
9 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. PERSONAL
10 SERVICES MATCHING TRANSFER. Provided that in the event amounts appropriated
11 in the Personal Services Matching line item of the Operations appropriation
12 section are insufficient in the fiscal year to pay the amounts at the rates
13 stipulated by law to be paid for each of these items, an additional amount as
14 determined and requested by the Director of the Arkansas Department of
15 Transportation, and upon review by the Arkansas Legislative Council or Joint
16 Budget Committee, will be transferred by the Secretary of the Department of
17 Finance and Administration and the Auditor of State from the Maintenance and
18 General Operation line items to the Personal Services Matching line item of
19 the Operations appropriation section to enable the Arkansas Department of
20 Transportation to pay the required matching funds.
21 The provisions of this section shall be in effect only from July 1, 2024
22 2025 through June 30, 2025 2026.

24 SECTION 16. COMPLIANCE WITH OTHER LAWS. Disbursement of funds
25 authorized by this act shall be limited to the appropriation for such agency
26 and funds made available by law for the support of such appropriations; and
27 the restrictions of the State Procurement Law, the General Accounting and
28 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary
29 Procedures and Restrictions Act, or their successors, and other fiscal
30 control laws of this State, where applicable, and regulations promulgated by
31 the Department of Finance and Administration, as authorized by law, shall be
32 strictly complied with in disbursement of said funds.

34 SECTION 17. LEGISLATIVE INTENT. It is the intent of the General
35 Assembly that any funds disbursed under the authority of the appropriations
36 contained in this act shall be in compliance with the stated reasons for

1 which this act was adopted, as evidenced by the Agency Requests, Executive
2 Recommendations and Legislative Recommendations contained in the budget
3 manuals prepared by the Department of Finance and Administration, letters, or
4 summarized oral testimony in the official minutes of the Arkansas Legislative
5 Council or Joint Budget Committee which relate to its passage and adoption.

7 SECTION 18. EMERGENCY CLAUSE. It is found and determined by the
8 General Assembly, that the Constitution of the State of Arkansas prohibits
9 the appropriation of funds for more than a one (1) year period; that the
10 effectiveness of this Act on July 1, 2025 is essential to the operation of
11 the agency for which the appropriations in this Act are provided, and that in
12 the event of an extension of the legislative session, the delay in the
13 effective date of this Act beyond July 1, 2025 could work irreparable harm
14 upon the proper administration and provision of essential governmental
15 programs. Therefore, an emergency is hereby declared to exist and this Act
16 being necessary for the immediate preservation of the public peace, health
17 and safety shall be in full force and effect from and after July 1, 2025.
