36      SECTION 38. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS

1 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. FUND

2 TRANSFER PROVISION. Upon approval of the Chief Fiscal Officer of the State,

3 the Arkansas Division of Environmental Quality may transfer from various

4 department funds to the Division of Environmental Quality Fund Account the

5 sum of $1,500,000 in fiscal year 2024-2025 2025-2026 for the exclusive

6 purpose of supplementing funding for the appropriation provided in the State

7 Operations appropriation section. The funds shall be used for personal

8 services and operating expenses of the Arkansas Division of Environmental

9 Quality - State Operations. Funds which remain in the Division of

10 Environmental Quality Fund Account at the close of the fiscal year shall be

11 carried forward and made available for the same purpose for the following

12 fiscal year. These funds shall be used for the purpose stated above.

19  SECTION 39. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS

20 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. LANDFILL

21 POST-CLOSURE CLEAN UP RESTRICTIONS. Any expenditures in excess of $2,000,000

22 per site from the Landfill Post-Closure Trust Fund, as appropriated in the

23 Contractual Services line item of the Landfill Post-Closure Program

24 appropriation section, for corrective action to remedy environmental impacts

25 of closed disposal sites previously operated as a landfill pursuant to state

26 law, shall be subject to review and approval by the Arkansas Pollution

27 Control and Ecology Commission after addressing corrective actions needed to

28 address environmental impacts from permitted landfills closed properly.

29  The provisions of this section shall be in effect only from July 1, 2024

30 2025 through June 30, 2025 2026.

32  SECTION 40. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS

33 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. SHARED

34 SERVICES. (a)(1) The Chief Fiscal Officer of the State may create a Shared

35 Services paying accounts on his or her books and on the books of the

36 Treasurer of State and the Auditor of State for the payment of personal

1 services and operating expenses in the Shared Services Paying Account

2 Appropriation by the Department of Energy and Environment.

3   (2) The Chief Fiscal Officer of the State shall direct the transfer

5 appropriation section of this act on the books of the Treasurer of State, the

6 Auditor of State, and the Chief Fiscal Officer of the State.

7   (3) The transfer authority provided to the department in

8 subdivision (a)(2) of this section may be used to make transfers only within

9 the department's appropriation act or between other appropriation acts

10 authorized for the department.

11  (4) The provisions of this section shall be in effect from the date of

12 passage through June 30, 2025 2026.

13

14  SECTION 41. COMPLIANCE WITH OTHER LAWS. Disbursement of funds

15 authorized by this act shall be limited to the appropriation for such agency

16 and funds made available by law for the support of such appropriations; and

17 the restrictions of the State Procurement Law, the General Accounting and

18 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary

19 Procedures and Restrictions Act, or their successors, and other fiscal

20 control laws of this State, where applicable, and regulations promulgated by

21 the Department of Finance and Administration, as authorized by law, shall be

22 strictly complied with in disbursement of said funds.

23

24  SECTION 42. LEGISLATIVE INTENT. It is the intent of the General

25 Assembly that any funds disbursed under the authority of the appropriations

26 contained in this act shall be in compliance with the stated reasons for

27 which this act was adopted, as evidenced by the Agency Requests, Executive

28 Recommendations and Legislative Recommendations contained in the budget

29 manuals prepared by the Department of Finance and Administration, letters, or

30 summarized oral testimony in the official minutes of the Arkansas Legislative

31 Council or Joint Budget Committee which relate to its passage and adoption.

33  SECTION 43. EMERGENCY CLAUSE. It is found and determined by the

34 General Assembly, that the Constitution of the State of Arkansas prohibits

35 the appropriation of funds for more than a one (1) year period; that the

36 effectiveness of this Act on July 1, 2025 is essential to the operation of

1 the agency for which the appropriations in this Act are provided, and that in

2 the event of an extension of the legislative session, the delay in the

5 programs. Therefore, an emergency is hereby declared to exist and this Act

6 being necessary for the immediate preservation of the public peace, health

7 and safety shall be in full force and effect from and after July 1, 2025.
