9   AN ACT TO REPEAL THE STATUTE CONCERNING THE

10  PROHIBITION AGAINST A SCHOOL DISTRICT BOARD OF

11  DIRECTORS GRANTING A LEGAL TRANSFER UNDER CERTAIN

12  CONDITIONS; AND FOR OTHER PURPOSES.

16                       TO REPEAL THE STATUTE CONCERNING THE

17                       PROHIBITION AGAINST A SCHOOL DISTRICT

18                       BOARD OF DIRECTORS GRANTING A LEGAL

19                       TRANSFER UNDER CERTAIN CONDITIONS.

20

21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22

23  SECTION 1. Arkansas Code � 6-18-317 is repealed.

24  6-18-317. Prohibited transfers.

25  (a) Boards of directors of local school districts are prohibited from

26 granting legal transfers under � 6-18-316 when:

27  (1) Either the resident district or the receiving district is

28 under a desegregation-related court order; and

29  (2) The transfer in question would violate the court order.

30  (b) Each form filed with the Division of Elementary and Secondary

31 Education reporting a legal student transfer must be accompanied by an

32 affidavit signed by each member of both school district boards of directors

33 stating that the transfer does not violate the prohibition set forth in

34 subsection (a) of this section.

35  (c) If the transfer fails to comply with subsection (b) of this

36 section, the division shall withhold from each district state aid in an

1 amount equal to that to be generated by the student in question in the

2 respective districts.
