9 AN ACT TO AMEND THE LAWS CONCERNING EMPLOYEES OF A
10 MUNICIPALITY THAT PARTICIPATES IN THE ARKANSAS PUBLIC
11 EMPLOYEES' RETIREMENT SYSTEM; TO AMEND THE
12 REQUIREMENT THAT AN EMPLOYEE OF A MUNICIPALITY THAT
13 PARTICIPATES IN THE ARKANSAS PUBLIC EMPLOYEES'
14 RETIREMENT SYSTEM SHALL DECIDE WHETHER TO ELECT NOT
15 TO PARTICIPATE IN THE ARKANSAS PUBLIC EMPLOYEES'
16 RETIREMENT SYSTEM AND INSTEAD PARTICIPATE IN A LOCAL
17 RETIREMENT PLAN WITHIN NINETY (90) DAYS OF ASSUMING
18 OFFICE; AND FOR OTHER PURPOSES.

26 INSTEAD PARTICIPATE IN A LOCAL
27 RETIREMENT PLAN.

29 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

31 SECTION 1. Arkansas Code � 24-4-303(a)(1)(C)(i), concerning an
32 employee of a municipality that covers its employees under the Arkansas
33 Public Employees' Retirement System and his or her decision to opt into
34 participation in the local retirement plan instead, is amended to read as
35 follows:
36 (C)(i) If the employee elects not to continue

1 participation in the system and opts to participate in the local retirement
2 plan as provided under � 24-12-121 or � 24-12-123, instead, written notice of
3 the election shall be presented to the system in a form determined acceptable
4 by the system not later than ninety (90) calendar days after first assuming
5 office during his or her first term and any subsequent term.

7 SECTION 2. DO NOT CODIFY. Temporary language.
8 (a) An employee under � 24-4-303(a)(1)(C)(i), including without
9 limitation a mayor or city clerk of a city of the first class, shall have
10 ninety (90) days from the effective date of this act to elect not to
11 participate in the Arkansas Public Employees' Retirement System and instead
12 to participate in the local retirement plan as provided under � 24-12-121 or
13 � 24-12-123 by providing written notice of the election to the system in the
14 same form determined acceptable by the system under � 24-4-303(a)(1)(C)(i).
15 (b) The additional ninety (90) days provided in subsection (a) of this
16 section does not make the employee ineligible to exercise his or her right to
17 elect not to participate in the system and instead to participate in the
18 local retirement plan as provided under � 24-12-121 or � 24-12-123 during the
19 first ninety (90) days of his or her subsequent term as provided by this act.
