9              AN ACT CONCERNING VEGETABLE GARDEN PROTECTION; AND

10             FOR OTHER PURPOSES.

14                       CONCERNING VEGETABLE GARDEN PROTECTION.

16 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

18  SECTION 1. DO NOT CODIFY. Legislative intent.

19  The General Assembly intends to encourage and protect the development

20 of sustainable cultivation of vegetables and fruits at all levels of

21 production, including without limitation on private residential property for

22 personal consumption or noncommercial sharing, as an important interest of

23 the state.

25  SECTION 2. Arkansas Code Title 2, Chapter 1, Subchapter 1, is amended

26 to add an additional section to read as follows:

27  2-1-103. Vegetable garden protection -- Definitions.

28  (a) As used in this section:

29             (1) "Prohibit" means an act or failure to act by the governing

30 body of a local government that prevents a property owner from using his or

31 her private residential property to cultivate a vegetable garden after

32 compliance with generally applicable local laws and zoning requirements; and

33             (2) "Vegetable garden" means a plot of ground or an elevated

34 soil bed on private residential property where vegetables, herbs, fruits,

35 flowers, pollinator plants, leafy greens, or other edible plants are

36 cultivated for personal consumption or noncommercial sharing.

1   (b) A person may cultivate a vegetable garden for personal consumption

2 or noncommercial sharing on his or her own private residential property or on

3 the private residential property of another person with the permission of the

4 property owner in any county, municipality, or other political subdivision of

5 this state.

6   (c) A county, municipality, or other political subdivision of

7 this state shall not prohibit vegetable gardens on private residential

8 properties.
