19 PROHIBIT A COURT FROM GRANTING A UNIFORM
20 PETITION WHEN A PERSON IS SUBJECT TO AN
21 ACTIVE WARRANT OF ARREST.

23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

25 SECTION 1. Arkansas Code � 16-90-1414(a)(3)(A), concerning the content
26 of the uniform petition, is amended to read as follows:
27 (A) The uniform petition shall include a statement
28 verified under oath indicating:
29 (i) whether Whether the petitioner has felony
30 charges pending in any state or federal court and the status of the pending
31 felony charges as well as;
32 (ii) Whether the petitioner is subject to an active
33 warrant of arrest issued by any court; and
34 (iii) whether Whether the person is required to
35 register as a sex offender under the Sex Offender Registration Act of 1997, �
36 12-12-901 et seq.

1 SECTION 2. Arkansas Code � 16-90-1415, concerning the burden of proof
2 and standard of review for a uniform petition, is amended to add an
3 additional subsection to read as follows:
4 (g) A court shall not grant a uniform petition to seal under � 16-90-
5 1413 when the person is subject to an active warrant of arrest issued by any
6 court.
