11 ARKANSAS LOCAL POLICE AND FIRE RETIREMENT SYSTEM; TO
12 DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES.

19 POLICE AND FIRE RETIREMENT SYSTEM; AND
20 TO DECLARE AN EMERGENCY.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24 SECTION 1. Arkansas Code � 24-10-410 is amended to read as follows:
25 24-10-410. Delinquent payments Delinquency.
26 (a) If any a political subdivision fails to make any a payment or
27 reporting due the Arkansas Local Police and Fire Retirement System for a
28 period of ten (10) days after the payment is within five (5) calendar days of
29 the date the payment or reporting is due, the political subdivision shall
30 become delinquent, and the delinquency shall be certified according to the
31 rules established by the Board of Trustees of the Arkansas Local Police and
32 Fire Retirement System to the Treasurer of State.
33 (b) Until the delinquency, together with regular interest, is
34 satisfied, the Treasurer of State is authorized and directed to withhold all
35 moneys due the political subdivision by the state.

1 SECTION 2. EMERGENCY CLAUSE. It is found and determined by the
2 General Assembly of the State of Arkansas that the management of delinquent
3 payments collected for the benefit of municipal firemen's relief and pension
4 funds and policemen's pension and relief funds is in need of a change in
5 administration from the Arkansas Local Police and Fire Retirement System to
6 the Department of Finance and Administration for purposes of financial
7 security and efficiency; and that an effective date of July 1, 2025, is
8 necessary in order to allow time to complete programming and send educational
9 notices to covered employers of the procedures referenced in this act.
10 Therefore, an emergency is declared to exist, and this act being necessary
11 for the preservation of the public peace, health, and safety shall become
12 effective on July 1, 2025.
