9            AN ACT TO INCLUDE EMPLOYEES OF A METROPOLITAN PORT

10           AUTHORITY IN THE MEMBERSHIP OF THE ARKANSAS

11           EMPLOYEES' RETIREMENT SYSTEM; AND FOR OTHER PURPOSES.

15                       TO INCLUDE EMPLOYEES OF A METROPOLITAN

16                       PORT AUTHORITY IN THE MEMBERSHIP OF THE

17                       ARKANSAS EMPLOYEES' RETIREMENT SYSTEM.

19 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

20

21  SECTION 1. Arkansas Code � 24-4-101(28), concerning the definition of

22 "nonstate employees" under the Arkansas Public Employees' Retirement System,

23 is amended to read as follows:

24           (28) "Nonstate employees" means county employees, municipal

25 employees, rural waterworks facilities board employees, regional airport

26 authority employees, border municipal airport employees, metropolitan port

27 authority employees, public facilities board employees, regional solid waste

28 management board employees, joint county and municipal sanitation authority

29 employees, regional water distribution board employees, the employees of

30 economic development districts recognized as planning and development

31 districts under � 14-166-202, school employees, public water authority

32 employees, and the employees of the Intergovernmental Juvenile Detention

33 Council;

35  SECTION 2. Arkansas Code � 24-4-101(30)(A), concerning the definition

36 of "participating public employer" under the Arkansas Public Employees'

1 Retirement System, is amended to read as follows:

2                   (A) Any county, municipality, rural waterworks facilities

3 board, regional airport authority, border municipal airport authority,

4 metropolitan port authority, public facilities board, regional solid waste

5 management board, joint county and municipal sanitation authority, suburban

6 improvement district under � 14-92-502, public water authority, or regional

7 water distribution board in the state whose employees are included in the

8 membership of the Arkansas Public Employees' Retirement System;

9

10  SECTION 3. Arkansas Code � 24-4-101 is amended to add an additional

11 subdivision to read as follows:

12  (48) "Metropolitan port authority" means a metropolitan port

13 authority created under the Metropolitan Port Authority Act of 1961, � 14-

14 185-101 et seq.
