9   AN ACT TO AMEND THE ACHIEVING A BETTER LIFE

10  EXPERIENCE PROGRAM ACT; TO AMEND THE DEFINITIONS OF

11  "DISABILITY CERTIFICATION" AND "ELIGIBLE INDIVIDUAL"

12  TO CHANGE THE DISABILITY ONSET AGE FROM TWENTY-SIX TO

13  FORTY-SIX; AND FOR OTHER PURPOSES.

17                       TO AMEND THE ACHIEVING A BETTER LIFE

18                       EXPERIENCE PROGRAM ACT; AND TO AMEND THE

19                       DEFINITIONS OF "DISABILITY

20                       CERTIFICATION" AND "ELIGIBLE INDIVIDUAL"

21                       TO CHANGE DISABILITY ONSET AGE FROM

22                       TWENTY-SIX TO FORTY-SIX.

24 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

25

26  SECTION 1. Arkansas Code � 20-3-103(4), concerning the definition of

27 "disability certification" under the Achieving a Better Life Experience

28 Program Act, is amended to read as follows:

29  (4) "Disability certification" means, with respect to an

30 individual, a certification to the satisfaction of the United States

31 Secretary of the Treasury by the individual or the parent or guardian of the

32 individual that:

33                       (A) Certifies that:

34                       (i)(a)(1) The individual has a medically

35 determinable physical or mental impairment that:

36                                                 (A) Results in marked and severe

1 functional limitations; and

2                                          (B) Can be expected to result in

3 death; or

4                                       (2) Has lasted or can be expected to

5 last for a continuous period of not less than twelve (12) months; or

6                              (b) The individual is blind within the meaning

7 of � 1614(a)(2) of the Social Security Act; and

8                           (ii) The blindness or disability occurred before the

9 individual attained twenty-six (26) forty-six (46) years of age; and

10           (B) Includes a copy of the individual's diagnosis relating

11 to the individual's relevant impairment or impairments, signed by a physician

12 meeting the criteria of � 1861(r)(1) of the Social Security Act;

14        SECTION 2. Arkansas Code � 20-3-103(5), concerning the definition of

15 "eligible individual" under the Achieving a Better Life Experience Program

16 Act, is amended to read as follows:

17           (5) "Eligible individual" means an individual who for a taxable

18 year:

19           (A) Is entitled to benefits based on blindness or

20 disability under Title II or Title XVI of the Social Security Act, 42 U.S.C.

21 � 301 et seq., and the blindness or disability is a preexisting condition

22 that occurred before the date on which the individual attained twenty-six

23 (26) forty-six (46) years of age; or

24           (B) Has a disability certification filed with the United

25 States Secretary of the Treasury for the taxable year;

26

27        SECTION 3. DO NOT CODIFY. Effective date.

28        This act is effective on and after January 1, 2026.
