9            AN ACT TO REQUIRE REIMBURSEMENT FOR REMOTE ULTRASOUND

10           PROCEDURES AND REMOTE FETAL NONSTRESS TESTS IN THE

11           ARKANSAS MEDICAID PROGRAM; AND FOR OTHER PURPOSES.

17                       NONSTRESS TESTS IN THE ARKANSAS MEDICAID

18                       PROGRAM.

20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22  SECTION 1. Arkansas Code Title 20, Chapter 77, Subchapter 1, is

23 amended to add an additional section to read as follows:

24  20-77-153. Reimbursement for remote ultrasound procedures and remote

25 fetal nonstress tests.

26  (a)(1) The Arkansas Medicaid Program shall reimburse for remote

27 ultrasound procedures and remote fetal nonstress tests utilizing established

28 Current Procedural Terminology codes for remote ultrasound procedures and

29 fetal nonstress tests when the patient is in a residence or other off-site

30 location from the healthcare provider of the patient and the same standard of

31 care is met.

32           (2) Subdivision (a)(1) of this section shall apply to the fee-

33 for-service categories of the program and any managed care plan within the

34 program.

35  (b) A remote ultrasound and remote fetal nonstress test shall be

36 reimbursable when the healthcare provider uses digital technology that:

1   (1) Collects medical and other forms of health data from a

2 patient and electronically transmits the information securely to a healthcare

3 provider in a different location for interpretation and recommendation;

4   (2) Is compliant with the Health Insurance Portability and

5 Accountability Act of 1996, 42 U.S.C. � 1320d et seq., as it existed on

6 January 1, 2025; and

7   (3) Is approved by the United States Food and Drug

8 Administration.

9   (c) A remote fetal nonstress test shall be reimbursed under a Current

10 Procedural Terminology code 5905 in the same manner as an in-person clinic

11 fetal nonstress test with the place of service at home and shall use remote

12 monitoring solutions that are approved by the United States Food and Drug

13 Administration for on-label use for monitoring fetal heart rate, maternal

14 heart rate, and uterine activity.

15  (d) The Department of Human Services shall:

16  (1) Apply for any federal waiver, Medicaid state plan

17 amendments, or other authority necessary to implement this section; and

18  (2) Adopt rules to implement this section.

20  SECTION 2. DO NOT CODIFY. Rules.

21  (a) When adopting the initial rules required under this act, the

22 Department of Human Services shall file the final rules with the Secretary of

23 State for adoption under � 25-15-204(f):

24  (1) On or before January 1, 2026; or

25  (2) If approval under � 10-3-309 has not occurred by January 1,

26 2026, as soon as practicable after approval under � 10-3-309.

27  (b) The department shall file the proposed rules with the Legislative

28 Council under � 10-3-309(c) sufficiently in advance of January 1, 2026, so

29 that the Legislative Council may consider the rules for approval before

30 January 1, 2026.
