9          AN ACT TO CREATE THE WATER IN LINE ACT OF 2025; TO

10         AMEND THE LAW CONCERNING PENALTIES FOR MISDEMEANOR

11         OFFENSES RELATED TO VOTING; AND FOR OTHER PURPOSES.

15                       TO CREATE THE WATER IN LINE ACT OF 2025;

16                       AND TO AMEND THE LAW CONCERNING

17                       PENALTIES FOR MISDEMEANOR OFFENSES

18                       RELATED TO VOTING.

20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

21

22         SECTION 1. DO NOT CODIFY. Title.

23         This act shall be known and may be cited as "The Water in Line Act of

24 2025".

25

26         SECTION 2. DO NOT CODIFY. Legislative findings and intent.

27         The General Assembly finds that:

28         (1) Arkansas has a longstanding law prohibiting electioneering

29 within one hundred feet (100') of a polling place;

30         (2) Act 728 of 2021 applies to people who are not engaging in

31 electioneering activities;

32         (3) In certain circumstances, Act 728 of 2021 makes it a

33 criminal offense for a volunteer to bring water or food to someone waiting in

34 line to vote, a family member to accompany an elderly or disabled voter, and

35 a child to join his or her parent in line to vote; and

36         (4) The repeal of Act 728 of 2021 would have no effect on Arkansas's

1 electioneering prohibition, which would remain in place.

3   SECTION 3. Arkansas Code � 7-1-103(a)(24), concerning miscellaneous

4 misdemeanor offenses relating to elections, is repealed.

5   (24) A person shall not enter or remain in an area within one

6 hundred feet (100) of the primary exterior entrance to a building where

7 voting is taking place except for a person entering or leaving a building

8 where voting is taking place for lawful purposes.
